These terms are an agreement between you and TamLens ("we", "us") covering the tamlens.com website and the TamLens application at app.tamlens.com. By creating an account or using the service you accept them. If you are accepting on behalf of a company, you are confirming you have the authority to bind it.
You must be at least 18 and able to enter a contract.
TamLens estimates the size and competitiveness of a local market for a given industry, and maps where the demand sits. It draws on public and licensed data, including federal statistical sources and live search data, and it shows its working on every figure.
A report is an estimate, not a guarantee. Every figure in it is modeled from third-party data using assumptions we publish on the methodology page. Source data can be out of date, incomplete or wrong, and a model is a simplification of a real market by definition. Actual results in any market can and will differ from what a report projects.
TamLens does not provide investment, financial, legal, tax, accounting, real estate or other professional advice, and nothing in a report is a recommendation to open, buy, sell, lease or close anything. You are responsible for your own decisions. Before committing money to a market, verify what matters with your own research and your own advisors.
You need an account to run a scan. Give a real email address, keep access to it secure, and tell us promptly if you think someone else is using your account. You are responsible for activity under it.
One person or business, one account. Creating extra accounts to collect extra free credits is a breach of these terms and we may close every account involved and void the credits.
A new account gets one free credit. It shows the market score for whatever you scan, and nothing below it. The full report and the map are what a purchased credit unlocks. We say this plainly on the pricing page for the same reason it is here: a free scan is a score, not a report.
Free scans are also capped per day per connection, because each one costs us money upstream. Purchased scans are never capped.
One credit is one full scan: the report and its market map, for one industry in one city or at one address. Credits are sold in packs, priced on the pricing page. They are prepaid, tied to your account, and cannot be transferred or exchanged for cash.
Prices are in U.S. dollars and exclude any tax we are required to collect. Payment is taken at checkout by our payment processor; we never see or hold your card details. Prices can change, but a change never affects credits you have already bought.

You may not resell reports as a product of their own, republish them publicly at scale, present the methodology or the findings as your own product, or use them as source material for a competing market research tool. If you want to do something that sits near that line, ask us first. The answer is often yes.

Found a security problem? Email us and we will work with you. We will not pursue anyone who reports a vulnerability in good faith and gives us a reasonable chance to fix it.
The service, the software, the scoring methodology, the calibration work behind the benchmarks, the site content and the TamLens name and marks belong to us. These terms grant you a limited, non-exclusive, non-transferable, revocable right to use the service and the reports as described in section 7, and nothing else.
Underlying public data is not ours and we claim nothing over it. What is ours is how it is assembled, calibrated and scored.
We aim to keep TamLens up and accurate, but we do not promise uninterrupted service. Parts of the service depend on outside data sources, and when one of those goes down or changes, coverage can degrade or a figure can fall back to a labeled estimate. Reports are built to degrade visibly rather than fail silently, and anything estimated says so on the page.
We may add, change or remove features. If we ever discontinue the service, we will give account holders notice and refund unspent credits.
The service and everything in it are provided "as is" and "as available", without warranty of any kind, express or implied. To the fullest extent the law allows, we disclaim the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the service will be uninterrupted, secure or error-free, or that any figure, score, estimate, projection or recommendation is accurate, complete or current.
To the fullest extent the law allows, TamLens will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost business opportunity, lost data or the cost of substitute services, however caused and on any theory of liability, even if we were told such damages were possible.
Our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or one hundred U.S. dollars.
Some states do not allow certain exclusions, so parts of this section may not apply to you.
You agree to indemnify and hold TamLens harmless from claims, losses and reasonable legal costs arising out of your use of the service, your breach of these terms, or your use of a report in a way section 7 does not permit.
You can stop using TamLens at any time and ask us to close your account. We may suspend or close an account that breaches these terms, abuses the free tier, or puts the service or other users at risk. Where the breach is inadvertent we will normally warn you first.
If we close your account for a breach, unspent credits are forfeited. If you close your own account, unspent credits are forfeited as well, so use them or ask about a refund before you go. Sections 9, 11, 12, 13 and 16 survive termination.
We may update these terms. The date at the top will change, and if the change is significant we will email account holders before it takes effect. Continuing to use the service afterwards means you accept the new terms. If you do not, stop using the service and ask us to refund any unspent credits.
These terms are governed by the laws of the State of Iowa, without regard to its conflict of laws rules. Any dispute will be brought exclusively in the state or federal courts located in Iowa, and both of us consent to that jurisdiction.
Before filing anything, email us. Nearly everything is fixable in a conversation, and we would rather have it.
These terms, together with the Privacy Policy, are the entire agreement between us about the service. If any provision is found unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them to a successor if the business is sold.
